RENTING IN ENGLAND

The Renters’ Rights Act. What changed for you?

Rolling tenancies, the end of new Section 21 notices, and a new set of rules for private renting.

The first phase of the Renters’ Rights Act 2025 took effect on 1 May 2026 for most private assured tenancies in England. Different rules apply in Scotland, Wales and Northern Ireland, and to some other tenancy types.

New Section 21 notices can no longer be served for these tenancies. Most existing assured shorthold tenancies became assured periodic tenancies. Landlords seeking possession must use an applicable legal ground and follow the possession process.

The reforms also change the process for rent increases, rental bidding and requests to keep pets. This is a phased programme: do not assume every provision of the Act is already in force.

Check your tenancy type, the date of any notice and the official guidance. If you face eviction or a court deadline, obtain qualified advice promptly. A document pack cannot check the validity of a possession notice or defend a claim.
